Welcome to Gaens! These Terms and Conditions outline the rules and guidelines that apply to all purchases and interactions with our brand. By accessing our website or buying our products, you agree to the terms stated below. We strive to provide the highest quality products and services, ensuring a unique experience tailored to your needs. Please read these terms carefully before placing an order, as they clarify your rights and responsibilities.

TERMS AND CONDITIONS

SECTION 1 - GENERAL INFORMATION
These Terms and Conditions apply to all products and services offered by Gaens. By making a purchase, you agree to these terms.

SECTION 2 - PRODUCTS
All our products are handcrafted and unique. Custom-made items, such as grillz, may vary in design, shape, and color due to their bespoke nature.

SECTION 3 - ORDERS

Orders for custom-made products, including custom grillz, become final once a deposit or full payment has been received.

Each product is individually designed and manufactured according to the customer's specifications, impressions, scans, and/or design approval. Because every item is made specifically for the customer, all custom products are exempt from the statutory right of withdrawal where permitted by applicable law.

A non-refundable deposit is required before production begins. This deposit covers design work, labor, production preparation, and material costs. Once production has started, the deposit cannot be refunded.

Once production has commenced, the customer is legally obligated to pay the full remaining balance. Cancellation, refusal to accept delivery, failure to respond, failure to provide required information, or any other action that prevents completion of the order does not release the customer from the obligation to pay the remaining balance in full.

The remaining balance must be paid in full before the order will be shipped or made available for collection. GAENS reserves the right to withhold shipment until full payment has been received.

Ownership of all custom-made products remains with GAENS until the full purchase price has been paid.

If payment is not received within the agreed payment term, GAENS reserves the right to suspend delivery and recover the outstanding amount through a debt collection agency or legal proceedings. Where permitted by applicable law, the customer shall also be liable for all statutory interest, reasonable collection costs, legal fees, and any additional costs incurred in recovering the debt.

Design previews, 3D renders, and digital approvals must be reviewed carefully by the customer before production begins. Once the customer has approved the design, any requested changes may be refused or subject to additional charges.

Custom-made products that remain unpaid after completion may be stored by GAENS for a reasonable period. Failure to respond or complete payment does not cancel the customer's payment obligation.

SECTION 4 - USAGE AND MAINTENANCE OF GRILLZ

Grillz are intended for decorative use only. Proper care and maintenance are required. Instructions for safe use will be provided; failure to follow these instructions is at the customer’s own risk.

SECTION 5 - LIABILITY
Gaens is not liable for any bodily harm, injury, or complications resulting from the use of our products, including grillz. Customers assume full responsibility for their use.

SECTION 6 - INTELLECTUAL PROPERTY
All designs and products are protected by copyright. Copying, reproduction, or distribution without explicit permission is strictly prohibited.

SECTION 7 - RETURNS POLICY
Returns are only accepted in the case of a manufacturing defect. Customers must contact us within 14 days of receiving the product. Custom-made items are not eligible for return unless a defect is present.

SECTION 8 - GOVERNING LAW
These terms are governed by the laws of the Netherlands. Any disputes will be resolved under Dutch jurisdiction.

SECTION 9 - USER COMMENTS, FEEDBACK, AND SUBMISSIONS
If you submit any comments, suggestions, or other materials, you grant us the right to use, edit, and distribute them. You remain solely responsible for the content of your submissions.

SECTION 10 - PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy. Please review our Privacy Policy. 

SECTION 11 - ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, there may be errors, inaccuracies, or omissions in product descriptions, pricing, promotions, or other content. We reserve the right to correct any errors and update information without prior notice, even after an order has been placed.

SECTION 12 - MODIFICATIONS TO TERMS AND CONDITIONS
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website.
